By accessing and using Scoot & Smile's e-scooter rental services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description

Scoot & Smile provides e-scooter rental services in San Diego County, including:

  • E-scooter rentals for various durations (half-day, full-day, multi-day, weekly)
  • Free delivery and pickup anywhere in San Diego County
  • Safety equipment (helmet, backpack, lock, charger)
  • Guided tours and experiences
  • Group and corporate rental services

3. Eligibility and Requirements

Age Requirements

  • Renters must be at least 18 years old
  • Minors (16-17) may rent with parental consent and supervision
  • Children under 16 are not permitted to operate e-scooters

Other Requirements

  • Valid government-issued photo ID required
  • Must provide accurate contact and delivery information
  • Must agree to safety briefing and equipment inspection
  • Must comply with all local traffic laws and regulations

4. Rental Terms and Pricing

Pricing

  • Half-day rental: $35
  • Full-day rental: $75
  • Multi-day rental: $180 (3+ days)
  • Weekly rental: $350
  • All prices include safety equipment and free delivery/pickup

Payment Terms

  • Payment is due at time of booking
  • We accept major credit cards and digital payments
  • Security deposit may be required for extended rentals
  • Cancellations must be made at least 24 hours in advance for full refund

5. Safety Requirements

Mandatory Safety Measures

  • Helmet must be worn at all times while operating the e-scooter
  • Follow all traffic laws and local regulations
  • Do not exceed posted speed limits or manufacturer specifications
  • Do not operate under the influence of alcohol or drugs
  • Inspect equipment before each use

Prohibited Activities

  • Riding on sidewalks where prohibited
  • Carrying passengers (single rider only)
  • Performing stunts or reckless maneuvers
  • Using e-scooter for commercial delivery or rideshare
  • Modifying or tampering with equipment

6. Equipment Care and Responsibility

As a renter, you are responsible for:

  • Proper care and handling of all rental equipment
  • Securing the e-scooter when not in use with provided lock
  • Reporting any damage or malfunction immediately
  • Returning equipment in the same condition as received
  • Charges for lost, stolen, or damaged equipment

7. Liability and Insurance

Limitation of Liability

Scoot & Smile provides equipment in good working condition but cannot guarantee against all risks. By renting our equipment, you acknowledge and assume the inherent risks of e-scooter operation.

Renter Responsibility

  • You are liable for any damage to persons or property while using our equipment
  • You agree to indemnify Scoot & Smile against claims arising from your use
  • Personal insurance coverage is recommended
  • Report all accidents or incidents immediately

8. Cancellation and Refund Policy

  • Cancellations made 24+ hours in advance: Full refund
  • Cancellations made 12-24 hours in advance: 50% refund
  • Cancellations made less than 12 hours in advance: No refund
  • Weather-related cancellations: Full refund or rescheduling
  • Equipment malfunction: Full refund or replacement

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Scoot & Smile and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

11. Dispute Resolution

Governing Law

These terms are governed by the laws of the State of California and the United States.

Dispute Resolution Process

  • First, contact us directly to resolve any issues
  • If unresolved, disputes will be handled through binding arbitration
  • Arbitration will be conducted in San Diego County, California
  • Class action lawsuits are waived

12. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website with an updated "Last updated" date. Your continued use of our services after changes constitutes acceptance of the modified terms.

13. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
